These Terms of Use (“Terms”) explain the rules and conditions that apply to your access to and use of this website and any related web pages, digital properties, or online services operated by Black Hawk College East Foundation (collectively, the “Site”).

The Site is provided for informational, educational, fundraising, and operational purposes related to the mission of Black Hawk College East Foundation and for general public access to Foundation-related information and services. Black Hawk College East Foundation reserves the right, but does not assume the obligation, to review, edit, or remove User Content that is unlawful, inappropriate, or in violation of these Terms.
You acknowledge that electronic communications, including emails and submissions via the Site, may not be fully secure or confidential. Certain authorized personnel of Black Hawk College East Foundation may have access to such communications for operational, maintenance, or security purposes.

TO THE FULLEST EXTENT PERMITTED BY LAW, BLACK HAWK COLLEGE EAST FOUNDATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE.
YOUR SOLE REMEDY IS TO DISCONTINUE USE OF THE SITE.
The Site may allow users to make donations, event payments, or other financial contributions through third-party payment processors. Black Hawk College East Foundation does not store or process credit card or bank account information.
We are not responsible for transmission errors, technical failures, or interruptions affecting payment processing. All financial transactions are subject to the terms and conditions of the applicable third-party provider.
You agree to defend, indemnify, and hold harmless Black Hawk College East Foundation and its officers, directors, employees, and agents from any claims arising from your use of the Site or violation of these Terms.
By using the Site, you consent to receive communications electronically. Such communications satisfy any legal requirement that they be in writing.
Black Hawk College East Foundation is not responsible for content posted by users or third parties on social media platforms. Engagement on third-party platforms is governed by the respective platform’s terms and policies.
These Terms are governed by the laws of the State of Illinois. Any disputes shall be brought in the state or federal courts located in Rock Island County, Illinois.
The Site is operated from the United States and intended primarily for United States of America users. Access from other locations is at your own risk and subject to local laws.
At the sole discretion of Black Hawk College East Foundation, disputes may be resolved by binding arbitration administered by the American Arbitration Association. Arbitration shall be conducted on an individual basis; class actions are not permitted.
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement regarding use of the Site.
